UK scientists are testing a breathalyzer for earlier mesothelioma detection. ・ A UK-based medical manufacturer has announced that it will start running clinical trials to test whether a disease breathalyzer can detect malignant mesothelioma before the disease’s symptoms start to appear. ・ Cambridge-based Owlstone Medical will be partnering with the International Association of Heat and Frost Insulators and Allied Workers (IAHFIAW) in the U.S. and Canada. IAHFIAW members are at high risk of developing mesothelioma. ・ Those who work in construction and manufacturing are at particularly high risk of asbestos exposure and mesothelioma, according to Vogelzang Law. But because of the disease’s lengthy latency period of 40-50 years, mesothelioma can be difficult to diagnose until it’s in its later stages. ・ According to Owlstone’s press release, the company will be testing the device, known as Breath Biopsy. The device will analyze various chemicals found in IAHFIAW members who have documented exposure to asbestos and have confirmed malignant mesothelioma. ・ The project will be divided into two phases. First, scientists will identify the volatile organic compounds (VOCs) in the participants’ breath. The next step will be to conduct a blind study to determine whether present biomarkers are predictive of having the disease. ・ All of the breath samples will be collected using the ReCIVA Breath Sampler from Owlstone Medical. The samples will be analyzed at the company’s Breath Biopsy Laboratory in Cambridge. ・ The study is expected to last three years and is being partly funded by the non-profit organization Tissue Bank Asbestos Research Charitable Trust. ・ Earlier diagnosis of malignant mesothelioma can lead to more effective treatment and a longer life. Currently, early detection of the disease is challenging, which leads to poor prognosis for patients. ・ “Through this partnership, we are looking not only to advance the early diagnosis of malignant mesothelioma, but also to demonstrate that breath-based screening has the potential to have a substantial impact on a wide range of environment-driven disease,” said Billy Boyle, founder of Owlstone Medical.

🗽 New York Construction Worker’s Mesothelioma Lawsuit Clears Legal Hurdle (Full Article on ⬇️ ・ When Louis Decanio died of malignant mesothelioma in February of 2016, the source of his illness was clear: he had worked as part of a clean-up crew in New York City from 1958 to 1966, and had been responsible for removing boiler parts after they had been disassembled. He had a clear memory that the boilers were manufactured by Kohler Co., and upon learning that those parts were contaminated with asbestos, he and his wife filed a lawsuit seeking compensation for his illness. Though Mr. Decanio has died, the lawsuit continues. Kohler argued that the case should be dismissed based upon a previous decision in another mesothelioma lawsuit. Recently their motion for summary judgment was heard by Judge Manuel Mendez of the New York Asbestos Litigation Court, who denied their motion, explaining that the case that they referenced was not relevant to Mr. Decanio’s situation. ・ Carting away asbestos parts led to mesothelioma In a deposition that Mr. Decanio gave before his mesothelioma death, he detailed how he had been exposed to Kohler’s asbestos-contaminated boiler parts. He described the frayed gaskets that he would load into carts and take away, as well as the fact that he was often on site when they boilers were being disassembled. In response, Kohler’s attorneys argued that the removal of parts after dismantling was not a foreseeable use of the product and that therefore the company owed no duty of care to anybody who was carrying parts away. Mr. Decanio’s attorney countered that there is an expectation that boilers would eventually be replaced or updated, and that removing parts would be within the scope of foreseeable use.

Montana Passes Law to Protect Firefighters with Mesothelioma and Other Cancers ⬇️ ・ It has been well established that malignant mesothelioma is a significant risk for firefighters. Studies have shown that even brief exposure to asbestos can lead to the rare and deadly form of cancer, and despite increased protections that have been provided for first responders, the need for quick action to protect lives and property often leads to them breathing in the deadly carcinogen that makes up the infrastructure of homes, business establishments and public buildings. When a firefighter is diagnosed with an asbestos-related disease, his years of service should merit the immediate provision of the funds needed to help them, but that is not always the case, particular when it comes to workers’ compensation benefits, which shift from state to state. Today the state of Montana put an end to their workers’ compensation rule that precluded firefighters from getting the benefits that they need. ・ “Presumptive Law” Will Make A Real Difference for Firefighters The change in Montana’s law signed by Governor Steve Bullock will be of particular benefit to firefighters diagnosed with malignant mesothelioma. The state’s first responders have been fighting for twenty years for what is known as a “presumptive law” that makes it easier for them to get benefits when they’ve been diagnosed with specific types of occupational diseases. Montana had been on of only a few states without a presumptive law, and that meant that insurers could easily deny their claims for benefits. Now, as long as a firefighter served for a certain amount of time, a mesothelioma diagnosis is considered a valid workers’ compensation claim unless the insurer can prove that they were not exposed to enough smoke or particles to have caused illness. The law will take effect July first, and extends backwards to 2014.
